Draft – still to be checked by a lawyer

Draft: this text is still being reviewed by a lawyer. Your statutory rights as a consumer always apply, even if something is missing here.

Terms for buyers

These terms apply when you buy a robot through Arrivi. They explain who your seller is, what Arrivi does and which rights you have. At the bottom is the annex for the country you have your robot delivered to: it prevails where the law of that country gives you more protection.

1. Who we are and who your seller is

Arrivi ([to be completed]) is an online marketplace. We do not sell robots ourselves. You buy from the supplier named as the seller on the product page, in your cart and in your order. You make the purchase contract with that seller.

Arrivi handles the payment on behalf of the seller, holds your money until your robot has arrived and your cooling-off period is over, and helps with withdrawals, returns and complaints. The seller is responsible for the robot itself (delivery, quality, legal guarantee). Every seller on Arrivi is a business, so your consumer rights always apply.

2. Account and ordering

To order, you create an account. Keep your details correct and your password secret.

You first choose the country you want delivery to. Prices are in euro, including VAT. Your order is final once you click the order button and the payment at Stripe has succeeded. Your order, with its seller, then appears in your account.

3. Payment and buyer protection

You pay through Stripe, a licensed payment service provider. Arrivi does not see your card details.

Your money does not go straight to the seller. It stays with Stripe until your cooling-off period is over: 14 days after you received the robot (if you do not confirm receipt, we count from 7 days after shipping). If you report a problem or request a return in that time, we do not pay the seller until it is resolved.

4. Pre-orders and deposits

You can reserve a robot that is not available yet with a deposit. The deposit is never more than half the price. A pre-order is only possible if the seller commits to shipping within 80 days; that shipping time is on the product page.

You pay the remainder only when the robot is ready to ship. You will get a payment request for it.

The deposit is an advance payment on the price. You may withdraw from a pre-order until delivery, without giving a reason: you then get the full deposit back within 14 days.

If the remainder is still unpaid 14 days after the payment request, or the seller has not got the robot ready or shipped it 14 days after the promised shipping time, Arrivi reminds the party that has to act. If nothing has changed after 60 days, Arrivi decides: it cancels the pre-order and refunds everything you paid, or it extends the term to a new date. You get the decision and the reason by e-mail.

5. Delivery

The seller delivers within the shipping time on the product page, and without an agreed time within 30 days at the latest. If the seller does not deliver on time, you may give a reasonable extra period. If that also passes, or if the date was essential to you, you may terminate the purchase and get back everything you paid.

Arrivi only delivers to the country you choose when ordering.

6. Right of withdrawal (cooling-off period)

You may withdraw from the purchase within 14 days after receiving the robot, without giving a reason. With a pre-order you can also do this before delivery.

You withdraw on Arrivi with the “Withdraw from contract here” button on your order page or the link in your order confirmation, with the model form or with a clear statement by e-mail to [to be completed]. You get a confirmation by e-mail straight away, with the date and time your withdrawal came in.

After withdrawal you get all payments back within 14 days, including standard delivery costs. The seller may wait with the refund until the robot is back or you have shown that you sent it back. Unless the seller says otherwise, you pay the cost of sending it back.

Handle the robot with care. You may try it out as you would in a shop. If you use it more than that, the seller may charge for the loss in value.

7. Legal guarantee and complaints

Every robot must do what you may expect from its description. If it does not, you are entitled to repair or replacement, and if that fails, to a price reduction or termination. How long this right lasts differs per country: see the annex.

If you choose repair, the legal guarantee is extended by 12 months under the EU rules on the right to repair. A manufacturer's guarantee comes on top of your statutory rights and never replaces them.

Report a problem through your order on Arrivi. The seller responds within the deadline that applies in your country (see the annex). If the seller does not resolve it, Arrivi decides about the money we hold.

8. What Arrivi does and what we are liable for

Arrivi checks sellers before they may sell and makes sure the platform services (website, payment, messages, returns) work properly. We are liable for these as the law provides. Your rights against the seller always remain; these terms do not limit any right the law gives you.

9. Law and disputes

These terms are governed by Dutch law. If you live in another EU country, you always keep the protection of the mandatory rules of that country.

If you cannot resolve a dispute with the seller and Arrivi, you can turn to the dispute body in the annex or to the courts in your own country. For help with a dispute with a seller in another EU country, you can contact the European Consumer Centre in your country.

10. Changes

We may change these terms. An order is governed by the terms that applied when you placed it.
